Terms & Conditions of Sale

These Terms & Conditions of Sale (“Terms”) govern purchases of products and services from T-Shirt Envy LLC (“T-Shirt Envy,” “TSE,” “we,” “us,” or “our”) through TSE websites, applications, Design Studio, online checkout, approved electronic invoices, and in-store transactions where these Terms are presented or incorporated.

T-Shirt Envy specializes in custom and made-to-order products and services, including custom apparel, DTF printing, DTG printing, screen printing, embroidery, DTF transfers, artwork and design services, customer-supplied garments where accepted, TSE-sourced garments, supplier-sourced products, standard production, expedited production, pickup, shipping, and related services.

Because most TSE products are produced specifically for an individual customer’s specifications, different cancellation, return, remake, and refund rules may apply than would apply to ordinary off-the-shelf retail merchandise.

By placing an order after being presented with these Terms, you agree to the version of these Terms applicable to your transaction.


1. Acceptance of Terms

Before completing checkout, you will be asked to review your order and affirmatively accept these Terms and TSE’s applicable Refund/Cancellation Policy.

Your acceptance applies to the order specifications presented to you at checkout or otherwise approved by you, including, where applicable:

  • Garment style and brand
  • Garment color
  • Sizes
  • Quantities
  • Artwork and text
  • Spelling, names, dates, and numbers
  • Decoration locations
  • Production method
  • Selected turnaround
  • Shipping or pickup method
  • Artwork or design charges
  • Service and expedited-production charges
  • Taxes and other disclosed charges

If an order-specific quote, invoice, approved proof, or written agreement contains terms that directly conflict with these general Terms, the specifically agreed order terms will control for that particular issue.

Electronic acceptance of these Terms is intended to have the same effect as acceptance of a written agreement.


2. Custom and Made-to-Order Products

Most TSE products are customized specifically for the customer.

Custom products include merchandise that is printed, decorated, embroidered, personalized, altered, manufactured, ordered from a supplier specifically for the customer, or otherwise prepared according to customer-selected specifications.

Because custom merchandise may have limited or no resale value after materials have been ordered or production has begun, cancellation, return, exchange, and refund eligibility may become limited as the order progresses.

Nothing in these Terms eliminates any consumer right or remedy that cannot legally be waived.


3. Orders and Customer Responsibility

Customers are responsible for reviewing the accuracy of their order before approving it or submitting payment.

Please carefully verify all applicable:

  • Garments
  • Styles
  • Colors
  • Sizes
  • Quantities
  • Artwork
  • Spelling
  • Names
  • Numbers
  • Dates
  • Print or embroidery locations
  • Artwork dimensions
  • Orientation
  • Production method
  • Shipping information
  • Pickup location
  • Turnaround selection

TSE will produce orders based on the information and approvals provided by the customer.

A mistake contained in information or artwork supplied or approved by the customer is considered a Customer-Approved Error.

An order that materially differs from the customer’s accepted order specifications because of an error made during TSE’s production process may constitute a TSE Production Error.

These situations are handled differently as explained below.


4. Pricing and Payment

Prices are based on the products, services, quantities, sizes, decoration specifications, turnaround, artwork requirements, supplier availability, and other options selected for the order.

Applicable taxes, shipping charges, artwork charges, expedited-production charges, service fees, and other required charges will be disclosed before payment whenever applicable.

TSE may use Square or another approved payment processor to process transactions. Sensitive payment credentials should be handled by the applicable payment provider rather than stored directly by TSE except as permitted through supported payment infrastructure.

Payment authorization does not guarantee availability of merchandise that becomes unavailable because of supplier inventory changes or other circumstances outside TSE’s reasonable control.

If a material pricing or configuration error is identified before production, TSE may contact the customer with corrected information. The customer will be given an appropriate opportunity to approve the correction or cancel the affected portion of the order before customized production proceeds.


5. Artwork and Proof Approval

When TSE provides an artwork proof, digital mockup, Design Studio preview, or other approval image, the customer is responsible for reviewing it carefully.

Unless specifically stated otherwise, a proof primarily represents the approved:

  • Artwork
  • Text and spelling
  • Composition
  • General sizing
  • Orientation
  • Design content
  • General placement

Physical decoration placement may follow TSE’s established production standards unless exact placement measurements or requirements have been specifically agreed to in writing.

Once a customer approves the final artwork or proof, that approved version becomes TSE’s authorization to proceed with production.

Changes requested after approval may:

  • Delay production
  • Require additional artwork or production charges
  • Require a revised completion estimate
  • Require a new proof
  • Be impossible once production has begun

TSE is not responsible for correcting information that was clearly shown in an approved proof and was approved by the customer.

This does not excuse TSE from responsibility if TSE produces something materially different from the approved proof or accepted order specifications.


6. Customer-Supplied Artwork and Files

Customers may provide photographs, logos, trademarks, artwork, text, graphics, characters, illustrations, or other materials for reproduction.

You are responsible for ensuring that files you submit are accurate and suitable for the intended use.

TSE may make reasonable technical adjustments necessary for production, such as resizing, file conversion, color-profile adjustments, background removal, or other preparation. Material design changes requiring customer approval will be handled through the applicable proof process.

Low-resolution or poor-quality artwork may produce less-than-ideal results. TSE may notify you when significant quality concerns are identified, but the customer remains responsible for the quality of source artwork supplied to TSE.


7. Intellectual Property Authorization

By submitting artwork, photographs, logos, trademarks, characters, text, designs, or other content to TSE, you represent that you own the material or have authorization sufficient to permit TSE to reproduce it for your order.

You authorize TSE to reproduce, process, modify as technically necessary, and manufacture the submitted material solely as reasonably necessary to fulfill your order and related approved services.

TSE may decline, suspend, or cancel work that TSE reasonably believes:

  • Infringes intellectual-property rights;
  • Uses protected material without appropriate authorization;
  • Is fraudulent;
  • Violates applicable law; or
  • Otherwise cannot lawfully be produced.

If a third party makes a claim arising from material you submitted without the necessary rights or authorization, you are responsible for resolving the rights issue and, to the extent permitted by law, for reasonable losses caused by your breach of this authorization.

TSE-Created Artwork

Ownership and licensing rights for original artwork created by TSE as part of a paid design service will be governed by the applicable quote, invoice, design-service terms, or separate written agreement.

Payment for merchandise alone should not be interpreted as transferring intellectual-property rights beyond those expressly granted in the applicable order documents.


8. Garment Selection and Sizing

Garment sizing can vary between manufacturers, brands, styles, materials, colors, and production batches.

A size labeled “Large” in one garment style may not have identical dimensions to a “Large” in another style.

Customers are responsible for reviewing available sizing information before ordering.

TSE is not responsible for normal manufacturer sizing variations when the garment supplied matches the brand, style, color, and size ordered.

If TSE supplies a materially different garment or size from what the customer ordered without an approved substitution, the issue may qualify as a TSE Production Error.


9. Customer-Supplied Garments

TSE may accept customer-supplied garments or merchandise for certain decoration services.

Customer-provided products can carry risks that do not exist when TSE controls product sourcing.

These risks can include:

  • Existing defects
  • Fabric incompatibility
  • Heat sensitivity
  • Dye migration
  • Unknown coatings or treatments
  • Manufacturing defects
  • Material shrinkage
  • Discoloration
  • Press marks
  • Product irregularities
  • Limited or unavailable replacements

Decoration processes may involve heat, pressure, ink, adhesive, pretreatment, curing, embroidery equipment, or other production methods.

TSE will use reasonable care when decorating accepted customer-supplied products. However, TSE cannot guarantee how unknown materials, coatings, dyes, or manufacturing conditions will react to the decoration process.

For products identified as unusually high-risk, TSE may require a separate Customer-Supplied Garment Acknowledgment before production.

TSE is not responsible for damage caused solely by a latent defect, material incompatibility, manufacturing condition, or other problem with customer-supplied merchandise that TSE could not reasonably identify before decoration.

Nothing in this section excludes responsibility that cannot lawfully be excluded, including responsibility for TSE’s own actionable negligence where applicable.


10. Supplier Inventory and Product Availability

Garment and product availability may depend on TSE inventory and third-party supplier inventory, including inventory available through suppliers such as SanMar and S&S Activewear.

Availability can change because of:

  • Supplier warehouse inventory
  • Size and color availability
  • Warehouse location
  • Supplier shipping
  • Local inventory
  • Discontinued products
  • Backorders
  • Daily production capacity
  • Other supply-chain conditions

Service fees may apply. Service availability is subject to local and supplier warehouse inventory, as well as daily production capacity.

TSE will use commercially reasonable processes to validate applicable product availability before accepting or finalizing an order.

If merchandise becomes unavailable after an order is submitted, TSE may offer a comparable substitution, revised timeline, partial cancellation, or cancellation of the affected item.

TSE will not make a material substitution without the customer’s approval.


11. Production Turnaround

Production turnaround and shipping/transit time are different.

Production turnaround refers to the estimated time required for TSE to prepare and produce an order after the applicable production requirements have been satisfied.

Unless specifically stated otherwise for an order, production timing may depend upon:

  1. Payment being completed;
  2. Required artwork being received;
  3. Proof approval being completed, when applicable;
  4. Required garments or materials being available to the production location;
  5. Customer information being complete; and
  6. Any other required customer approval being received.

A delay in completing one of these requirements may move the estimated completion date.

Business-day estimates refer to days on which the applicable TSE operation is open for production and generally exclude holidays and applicable closures.

Estimated turnaround dates are not the same as guaranteed delivery dates unless TSE expressly identifies an order as having a guaranteed deadline in writing.

TSE will not intentionally advertise a production or shipment timeframe unless it has a reasonable basis for expecting the order can be completed within that timeframe.


12. Expedited Production Services

TSE may offer next-day, two-day, three-day, same-day, or other expedited production options depending on the product, supplier inventory, artwork readiness, order cutoff, production capacity, and other operational requirements.

Expedited Production does not mean Expedited Shipping.

If a customer requires both faster production and faster carrier delivery, both services must be selected or otherwise expressly included in the order.

Expedited-production charges compensate for accelerated production scheduling and may remain applicable when TSE has performed or reserved the expedited service.

An expedited order may still be affected by:

  • Late artwork approval
  • Customer changes
  • Supplier inventory
  • Supplier-delivery delays
  • Payment delays
  • Missing order information
  • Circumstances outside TSE’s reasonable control

If an expedited deadline cannot reasonably be met, TSE will communicate available options consistent with the circumstances and applicable law.


13. Order Changes and Cancellations

Because TSE products are generally made to order, cancellation eligibility depends on how far the order has progressed.

Relevant milestones may include:

Order Submitted → Payment Received → Garments Procured → Artwork Prepared → Proof Approved → Production Scheduled → Production Started → Completed

Before Nonrecoverable Costs Are Incurred

An order that has not entered customized production and for which TSE has not incurred material nonrecoverable costs may generally be eligible for cancellation and refund of the unearned portion of the order.

After Materials or Services Have Been Committed

If garments or materials have been specially procured, artwork services have been performed, or other nonrecoverable costs have been incurred, any available refund may be reduced by the reasonable value of completed services or nonrecoverable costs associated with the order.

After Production Begins

Once printing, embroidery, transfer production, customization, or other made-to-order production has begun, the customized portion of the order will generally no longer be eligible for cancellation because it is being manufactured specifically for the customer.

This does not affect remedies available because of a TSE Production Error or rights that cannot legally be waived.

Customer-requested changes after an order has entered production may require a new order or additional charge.


14. Refunds, Reprints, Remakes and Replacements

TSE’s objective is to produce the order that the customer approved.

TSE Production Error

Examples may include:

  • Production using the wrong approved artwork;
  • Wrong garment relative to the accepted order;
  • Wrong size relative to the accepted order;
  • Materially incorrect quantity;
  • Material print defect;
  • Material embroidery defect; or
  • Another material production defect caused by TSE.

When TSE confirms a production error, TSE will provide an appropriate corrective remedy based on the circumstances and applicable law. Remedies may include correction, reprint, remake, replacement, refund of an affected item, or another mutually acceptable resolution.

Customer-Approved Error

Examples include:

  • A misspelling shown in approved artwork;
  • An incorrect date supplied or approved by the customer;
  • An incorrect name or number supplied or approved by the customer;
  • Incorrect sizes selected by the customer;
  • Incorrect shipping information supplied by the customer; or
  • A design issue clearly visible in an approved proof.

Customer-approved errors ordinarily do not qualify as TSE production errors.

TSE may, at its discretion, offer a discounted remake or other accommodation, but is not required to absorb the cost of reproducing an order that accurately matches the specifications the customer approved.

Nothing in this policy limits rights or remedies that cannot lawfully be waived.


15. Production Tolerances

Garment decoration is a physical manufacturing process. Small variations can occur even when professional production standards are followed.

Reasonable production variation may occur in:

  • Print placement
  • Artwork dimensions
  • Garment dimensions
  • Garment construction
  • Ink appearance
  • Fabric texture
  • Dye appearance
  • Color reproduction
  • Embroidery
  • Product batches
  • Different decoration methods

Colors displayed on a phone, tablet, computer monitor, photograph, digital proof, or other screen may differ somewhat from the final printed product because screens produce color differently from inks, garment dyes, threads, and physical materials.

Garment color and dimensions may also vary slightly from one manufacturing batch to another.

These reasonable variations do not automatically constitute a production defect.

This section is not intended to excuse defective workmanship or a material failure to follow approved order specifications.


16. Pickup Orders

TSE may provide pickup options at applicable locations.

Customers should wait for a Ready for Pickup notification unless otherwise instructed.

TSE may require reasonable verification of the order or identity of the individual collecting merchandise.

Customers are encouraged to inspect their order promptly after pickup and contact TSE if they believe an item does not materially match the approved specifications.

A person collecting an order on the customer’s behalf may be treated as authorized when the customer has designated that person or otherwise provided reasonable authorization.

Unclaimed custom merchandise may require storage. TSE will provide reasonable notice before applying any storage fee or taking action regarding materially abandoned merchandise, and any such action will be subject to applicable law and any policy disclosed to the customer.


17. Shipping and Delivery

Customers are responsible for providing a complete and accurate shipping address.

Shipping or transit time begins separately from production turnaround.

Carrier delivery estimates are generally controlled by the carrier and are not the same as TSE production estimates.

TSE is responsible for properly preparing and tendering shipments according to the selected shipping service. TSE does not control ordinary carrier operations after a shipment has been transferred to the carrier.

Customers should promptly notify TSE about packages that appear lost, damaged, misdelivered, or materially delayed so TSE can assist with the appropriate carrier process.

Additional shipping charges resulting from an incorrect or incomplete address supplied by the customer may be the customer’s responsibility where legally permitted.

For online or other covered orders, if TSE determines that merchandise cannot be shipped within an applicable promised shipment timeframe, TSE will provide any delay notice, consent opportunity, cancellation option, or refund required by applicable law.


18. Saved Artwork and Reorders

TSE may allow customers to save approved artwork or designs for future orders.

Saved artwork can simplify reorders, but saving a design does not guarantee that:

  • The original garment will remain available;
  • A particular color or size will remain available;
  • Supplier pricing will remain the same;
  • The same production method will remain appropriate; or
  • Supplier inventory will be located in the same warehouse.

Reorders are subject to current product availability, pricing, production capacity, and applicable order terms.

Customers remain responsible for reviewing the specifications of every reorder before approval.


19. Customer Accounts, Design Studio and Privacy

Customers using a TSE account or Design Studio are responsible for providing accurate information and maintaining reasonable security over their login credentials.

You may not use TSE systems to:

  • Attempt unauthorized access;
  • Interfere with platform operation;
  • Introduce malicious software;
  • Conduct automated attacks or abusive scraping;
  • Place fraudulent orders;
  • Circumvent access controls; or
  • Use TSE services for unlawful activity.

Artwork and files uploaded through an account may be stored as necessary to provide the requested service, support saved designs, process reorders, maintain transaction records, resolve customer-service issues, and comply with legal requirements.

TSE’s collection and handling of account information, contact information, order information, artwork, analytics, notifications, and related data is also governed by TSE’s separate Privacy Policy.

Marketing communications, where applicable, will be handled separately from communications reasonably necessary to process or service an existing transaction.


20. TSE Club and Membership Benefits

When TSE Club or another membership program is active, applicable membership terms, benefits, rewards, eligibility requirements, and restrictions displayed at enrollment or checkout may also apply.

Membership benefits apply only to features that are currently offered.

TSE may establish reasonable rules concerning eligibility, rewards, redemption, expiration, fraud, abuse, or program modification.

Material changes will apply prospectively as required by applicable law and the applicable membership terms.

Future or unreleased features are not contractual benefits merely because they have been announced or considered.


21. Prohibited Orders and Conduct

TSE may decline or cancel an order where TSE reasonably believes the transaction:

  • Is fraudulent;
  • Violates applicable law;
  • Infringes third-party intellectual-property rights;
  • Involves unauthorized use of payment information;
  • Abuses TSE systems or personnel; or
  • Cannot reasonably or lawfully be fulfilled.

If TSE cancels an order for reasons unrelated to customer misconduct after receiving payment, TSE will provide an appropriate refund for unfulfilled merchandise or services as required by applicable law.


22. Quality Commitment and Warranty Matters

TSE will use commercially reasonable production practices to provide decoration services consistent with the customer’s approved specifications, subject to the reasonable production tolerances described in these Terms.

TSE does not guarantee that digital-screen colors will exactly match physical ink, thread, fabric, transfer, or garment colors.

TSE also does not manufacture most blank garments and therefore cannot guarantee that independently manufactured garments will be completely free from ordinary manufacturer variation.

Any rights or warranties that cannot lawfully be excluded remain unaffected.


23. Limitation of Liability

To the maximum extent permitted by applicable law, TSE will not be responsible for indirect, incidental, special, or consequential business losses resulting from an order, including lost profits, lost resale opportunities, lost promotional opportunities, or losses associated with an event, when those losses were not caused by conduct for which liability cannot lawfully be limited.

Where legally permitted, TSE’s monetary responsibility arising directly from a defective or incorrect order should generally be limited to the amount paid for the affected products or services, subject to any greater remedy required by applicable law.

Nothing in these Terms limits liability that cannot legally be limited or excluded.


24. Events Outside Reasonable Control

TSE will not be considered in breach solely because performance is delayed by extraordinary circumstances outside TSE’s reasonable control, such as:

  • Severe weather;
  • Natural disasters;
  • Government actions;
  • Major carrier disruptions;
  • Major supplier disruptions;
  • Utility failures;
  • Widespread technology outages; or
  • Similar events that could not reasonably have been prevented.

TSE will use commercially reasonable efforts to communicate material delays and identify available alternatives.

This section does not override any cancellation, refund, shipment-delay, or other remedy required by applicable law.


25. Payment Disputes and Resolution of Concerns

If you believe an order is incorrect or defective, we encourage you to contact TSE promptly so we can investigate and attempt to resolve the issue.

Please provide the applicable order number and, where helpful, photographs or other information showing the issue. Customers may be asked to retain the merchandise while TSE evaluates the claim.

TSE may compare the merchandise against:

  • The accepted order;
  • Approved artwork;
  • Approved proof;
  • Production records; and
  • Applicable production standards.

Contacting TSE directly often allows production issues to be resolved more quickly.

Nothing in these Terms requires a customer to waive a credit-card dispute, chargeback right, consumer remedy, or other right that cannot legally be waived.


26. Governing Law and Disputes

These Terms and transactions with TSE are intended to be governed by applicable federal law and the laws of the State of Florida, without eliminating any consumer protection that applies regardless of that choice of law.

Before beginning formal proceedings, the customer and TSE are encouraged to make a reasonable good-faith attempt to resolve the dispute through TSE customer service.

These Terms do not presently impose mandatory arbitration or a class-action waiver.

Any future arbitration, class-action waiver, mandatory venue, or similar dispute-resolution provision must be separately reviewed and approved before becoming part of these Terms.


27. Changes to These Terms

TSE may update these Terms periodically to reflect changes in products, services, technology, operations, or legal requirements.

Each version will have an effective date or version identifier.

The version accepted in connection with a particular transaction will continue to govern that transaction unless the customer and TSE subsequently agree otherwise or applicable law requires different treatment.

Updating the website Terms after an order is placed does not retroactively replace the version accepted for that order.


28. Contact T-Shirt Envy

Questions about an order, cancellation, refund, artwork approval, production issue, shipping issue, or these Terms may be submitted through TSE’s customer-service channels, the TSE website or application, or the applicable TSE location identified in the customer’s order.

Please include your TSE Order ID whenever possible so we can locate the applicable transaction.
